The owner of the online store tubane.ee (hereinafter the Online Store) is OÜ TUBANE DISAIN
(registry code 16529049), located at Iva põik 6, Mäeltküla, 70105 Viljandi Parish, Viljandi County.
Validity of the sales contract, product and price information
The terms and conditions apply when purchasing goods from the Online Store.
The prices of products sold in the Online Store are indicated next to the products. A delivery fee is added to the price. All prices for goods sold in the online store are in euros.
The delivery fee depends on the buyer’s location and the delivery method.
Information about the goods is provided in the Online Store directly next to the product.
Placing an order
To order goods, the desired products must be added to the shopping cart. To place an order, the required data fields must be filled in and a suitable delivery method selected. The total cost will then be displayed on the screen, which can be paid securely via the following payment methods:

Payments are mediated by Modena Estonia OÜ. Payment takes place outside the Online Store in a secure environment – when paying via bank link, in the secure environment of the respective bank, and when paying by credit card, in the secure environment of Modena Estonia OÜ. The Seller does not have access to the customer’s bank and credit card details. The contract enters into force upon receipt of the amount due in the Online Store’s current account.
The owner of the Online Store is the controller of personal data and transmits the personal data necessary for making payments to the authorized processor Modena Estonia OÜ.
If the ordered goods cannot be delivered due to stock depletion or for any other reason, the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded immediately, but no later than 14 days after the notification.
Delivery
Goods are shipped to the following countries: Estonia, Latvia, Lithuania
The shipping costs are borne by the buyer, and the corresponding price information is displayed next to the shipping method.
Shipments within Estonia generally reach the destination specified by the buyer within 28 working days from the entry into force of the sales contract. Delivery outside Estonia takes place within 35 calendar days.
In exceptional cases, the right is reserved to deliver the goods within up to 45 calendar days.
Right of withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods may not be used in any way other than what is necessary to verify the nature, characteristics, and functioning of the goods in the same way as is permitted for testing goods in a physical store.
If the goods have been used for purposes other than what is necessary to verify the nature, characteristics, and functioning of the goods, or if they show signs of use or wear, the Online Store has the right to reduce the refundable amount in accordance with the decrease in the value of the goods.
The costs of returning the goods are borne by the buyer, unless the reason for the return is that the product to be returned does not correspond to what was ordered (e.g., a wrong or defective product).
The buyer must return the goods within 14 days of submitting the application or provide proof that they have handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, the Online Store shall immediately, but no later than 14 days after receiving the withdrawal application, refund all payments received from the buyer under the contract.
The Online Store may refuse to make refunds until it has received the item that is the subject of the contract back or until the buyer has provided proof of having sent the item back, whichever occurs first.
If the buyer has explicitly chosen a delivery method other than the cheapest standard delivery method offered by the Online Store, the Online Store is not required to refund the consumer for costs exceeding those associated with the standard delivery method.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if, due to an error, the price of the goods in the online store is marked significantly below the market price.
Right to file a claim
The Online Store is responsible for the non-compliance or defect of the goods sold to the buyer, which already existed at the time of delivery and which manifests itself within up to two years from the delivery of the goods to the buyer. Within the first year from delivery, it is presumed that the defect already existed at the time of delivery. Rebutting this presumption is the obligation of the Online Store.
In the event of a defect, the buyer has the right to contact the online store within two months at the latest by sending an e-mail to info@tubane.ee.
The Online Store is not responsible for defects that have occurred after the delivery of the goods to the buyer.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer.
The Online Store will respond to the consumer’s complaint in writing or in a format that can be reproduced in writing within 15 days.
Direct marketing and processing of personal data
The Online Store uses the personal data entered by the buyer only for processing the order and shipping the goods to the buyer. The Online Store transmits personal data to transport service providers in order to deliver the goods.
The Online Store will send newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a wish to receive them by entering their e-mail address on the website and indicating their desire for direct mail notifications.
The buyer can opt out of offers and newsletters sent to their e-mail at any time by notifying us via e-mail or by following the instructions in the e-mail containing the offers.
Settlement of disputes
If the buyer has any complaints regarding the Online Store, they must be sent to the e-mail address info@tubane.ee
If the buyer and the Online Store are unable to resolve the dispute through agreement, the buyer may contact the Consumer Disputes Committee. The procedural conditions can be reviewed and an application submitted here. The Consumer Disputes Committee has the competence to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.
The buyer may turn to the European Union’s online dispute resolution platform.
